The Spam Act has been in existence since December 2003. And most people know that to send "spam" (or "electronic commercial messages" as they're technically known) you have to have consent and provide the ability to unsubscribe. But there are a few tips and traps that aren't as commonly known.

Standard-form consumer contracts have been around for as long as I can remember. Clients like them because they only have to have a contract drafted once instead of every time they enter into a transaction with a consumer. They save time and money. And nobody reads them anyway – until there’s a problem.

Refusal to supply can be the bane of many SMEs. Unfortunately, for the most part, suppliers are free to choose who they will supply. Often sitting down and talking with the supplier can help to address any concerns or reasons they might have for not supplying you. Keep in mind though, that they don't have to give you any reason if they choose not to.

Businesses and their financial controllers should remain alert to false billing and other scams that target their business. False billing scams reported to the ACCC in 2009 increased by nearly 60% over those reported in 2008.

One of my suppliers is demanding return of goods not supplied and demanding payment for the replacement of these goods. When asked for paperwork to substantiate these supposed stock losses nothing is forthcoming. Our company records can detail all deliveries and returns.

I went into a partnership with a person four months ago. It all went sour when she kept asking for more and more money to buy stock and I could never get her to prove where the money had gone. In the end I decided there would be no more money and I suggested that we brought in a third partner or sell the business. She said that she did not want another partner and that selling the business was not an option. What can I do? I want out now!

We currently own a business name (Sydney Designers) and are looking to register a domain name under the same name. However, the domain name (sydneydesigners.com and .com.au) have been purchased by another person, who is not using the domain as an operating website.
We understand that we can purchase this domain from the owner, but we were wondering if, as the ACN/ABN owners of the company, we have any rights to own the domain name?
